1. Acceptance of Terms

By accessing or using OctoSwop (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is provided on an as-is, as-available basis without any representations or warranties of any kind.

2. Description of Service

OctoSwop is a non-custodial cryptocurrency exchange platform that facilitates peer-to-peer swaps between digital assets. The Service allows users to exchange cryptocurrencies anonymously without the need for account creation, identity verification, or personal data submission.

3. No Account Required

The Service does not require you to create an account, provide a name, submit identification documents, or supply any personally identifiable information. Exchanges are initiated solely by providing cryptocurrency wallet addresses and the desired swap parameters.

4. Eligibility

By using the Service, you represent that you are of legal age in your jurisdiction and that your use of the Service does not violate any applicable law or regulation. You are solely responsible for ensuring compliance with the laws that apply to you.

5. Non-Custodial Nature

OctoSwop does not hold, store, or have access to your funds at any time beyond the duration of an active exchange. Once an exchange is completed, failed, or refunded, no funds remain under the control of the Service. You retain full ownership and responsibility for your digital assets at all times.

6. Exchange Process

When you initiate an exchange, you agree to send the specified amount of cryptocurrency to the deposit address provided. The Service will then send the exchanged cryptocurrency to the wallet address you specified. Exchange rates are determined at the time of the transaction and may vary depending on market conditions.

  • Float rate: The final rate is determined when your deposit is confirmed on the blockchain. The amount you receive may differ from the initial estimate.
  • Fixed rate: The rate is locked for a limited time. If the deposit is not received within the validity window, the exchange may be recalculated or cancelled.

7. Fees

Exchange fees are included in the quoted rate and displayed transparently before you confirm any exchange. Network transaction fees (miner fees) are separate and determined by the respective blockchain networks.

8. Refunds

If an exchange cannot be completed, the Service will attempt to refund the deposited amount to the refund address you provided (minus any applicable network fees). If no refund address was provided, recovery of funds may not be possible.

9. Risks

Cryptocurrency transactions are irreversible. You acknowledge and accept the inherent risks of dealing with digital assets, including but not limited to price volatility, blockchain delays, network congestion, and the possibility of total loss. The Service is not responsible for losses resulting from incorrect wallet addresses, network issues, or market fluctuations.

10. Prohibited Uses

You agree not to use the Service to:

  • Engage in money laundering, terrorist financing, or any other illegal activity
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to exploit, reverse-engineer, or tamper with the Service

11. Limitation of Liability

To the maximum extent permitted by law, the Service, its operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Service or inability to use the Service.

12. No Warranty

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at any particular time.

13. Changes to Terms

These terms may be updated from time to time. Continued use of the Service after any changes constitutes acceptance of the new terms. It is your responsibility to review these terms periodically.

14. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
